These Terms & Conditions ("Terms") govern your access to and use of Hoverise's Services. By accessing or using the Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.

Hoverise provides an educational coaching platform that enables businesses to develop entrepreneurial skills through AI-powered simulations, assessments, and coaching tools. Features may include personalized learning paths, business simulation environments, progress tracking, and collaboration tools. Specific features and availability may change over time.
You must be at least 18 years old or have proper authorization from your educational institution to use the Services. For users under 18, explicit parental or guardian consent is required before accessing the Services. You are responsible for safeguarding your account credentials and for all activities under your account.
Educational institutions may create accounts on behalf of their students and are responsible for obtaining appropriate permissions and maintaining compliance with applicable educational privacy regulations.
"Customer Data" means any data, content, or materials you (or your users) submit to or create within the Services, including learning progress, assessments, and business project data.

You may connect third-party applications or services. Their terms and privacy policies govern your use of those services. Hoverise is not responsible for third-party services.
We strive to maintain 99% uptime for the Services, measured monthly, excluding holidays, weekends, and scheduled maintenance. Planned maintenance will be announced with reasonable advance notice.
If you experience service downtime exceeding 72 consecutive hours, you may be eligible for service credits equal to 5% of your monthly service fees for each 72-hour period of downtime, with a maximum of one credit per day.
To claim service credits, you must notify us within 24 hours of the downtime incident. Credits cannot be redeemed for cash and are limited to one week of service fees per calendar month.
We provide technical support during standard business hours (9 AM - 5 PM CET, Monday through Friday). We aim to respond to support requests within 24 hours during business days.
Emergency support outside business hours may be available for critical issues affecting institutional operations, subject to additional terms.
We recognize the sensitive nature of educational data and implement additional protections for data used in educational contexts:
Upon termination of institutional agreements, we will delete or return educational data as requested, subject to legal retention requirements.
Subscription fees and usage-based charges are described at signup or in your order form. You authorize us to charge applicable fees and taxes. Fees are non-refundable unless required by law or expressly stated otherwise.
Our Privacy Policy describes how we handle personal data. By using the Services, you agree to the Privacy Policy and applicable data processing agreements.
We provide implementation and onboarding services to help you get started with the platform:
Implementation services are provided on a professional services basis. Specific timelines and deliverables will be outlined in your service agreement.
We implement reasonable administrative, technical, and organizational measures designed to protect the Services and Customer Data. You remain responsible for securing your accounts and any external systems you connect.
In the event of a security breach that may affect your data, we will notify you within 72 hours of becoming aware of the incident, in compliance with applicable data protection regulations.
Our security measures include encryption in transit and at rest, regular security assessments, access controls, and monitoring systems designed to detect and prevent unauthorized access.
Hoverise and its licensors retain all rights in the Services, documentation, and underlying technology (excluding Customer Data). You grant Hoverise a royalty-free license to use feedback you provide to improve the Services.
EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. EXCEPT FOR PAYMENT OBLIGATIONS, INDEMNIFICATION OBLIGATIONS, OR BREACHES OF CONFIDENTIALITY, EACH PARTY'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
These Terms remain in effect while you use the Services. Either party may terminate for material breach not cured within thirty (30) days after written notice. Upon termination, your access ceases and we will handle Customer Data according to our Privacy Policy and applicable law.
These Terms are governed by the laws of the Netherlands. The exclusive venue for disputes is the competent courts in the Netherlands. Mandatory consumer protection rights of your country of residence remain unaffected where applicable.
We may enhance or modify the Services and update these Terms from time to time. If we make material changes, we will provide notice. Your continued use after the effective date constitutes acceptance.
These Terms constitute the entire agreement regarding the Services and supersede prior agreements. If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a corporate transaction.
